This End User License Agreement and Terms of Use ("Terms") is a legal agreement between you ("You" or "User") and MySudoku.com ("We," "Us," or "Our"), governing your use of our website and services at MySudoku.com (the "Services"). Please read these Terms carefully before accessing or using our Services.

By using MySudoku.com, you confirm your acceptance of these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, please refrain from using our Services.

- Services: The MySudoku.com website, including over 17 million unique Sudoku puzzles, Samurai Sudoku grids, ranking features, and related content or functionalities.

- Content: All materials on MySudoku.com, including puzzles, text, graphics, rankings, user submissions, and advertisements, whether provided by Us, You, or third parties.

- Intellectual Property Rights: Rights under patent, trademark, copyright, trade secret laws, and other proprietary rights worldwide.

- Third-Party Providers: Entities like Google (AdSense, Analytics) that supply advertising, analytics, or hosting services to MySudoku.com.

- Unacceptable Content: Any illegal, offensive, or harmful content or behavior, including harassment, fraud, explicit material, or Intellectual Property Rights violations (see "User Conduct" below).

- EEA: European Economic Area.

- USA: United States of America.

By agreeing to these Terms, you opt into binding individual arbitration for disputes, waiving court trials unless you opt out within 30 days (see "Dispute Resolution for U.S. Users" below).

MySudoku.com offers the world’s largest online Sudoku collection, with over 17 million puzzles and a global community of players since 2016. These Terms outline your rights and obligations when using our Services. They apply to all interactions with MySudoku.com, including puzzle-solving, rankings, and content access.

We grant you a non-exclusive, personal, revocable, and non-transferable license to access and use MySudoku.com solely for lawful, personal, non-commercial purposes, subject to these Terms. This license does not include:

• Selling, distributing, or sublicensing our Services or Content.
• Copying, modifying, or creating derivative works from our Services (except as permitted by law).
• Reverse-engineering, decompiling, or hacking the website.
• Using Content for artificial intelligence, machine learning, or data mining without our written consent.

All rights not expressly granted are reserved by Us and our licensors.

• Access: You are responsible for securing an internet connection and any associated costs to use MySudoku.com. We do not guarantee compatibility with all devices or browsers.
• Availability: Services may be unavailable due to maintenance or technical issues, and we may modify or discontinue features without notice.
• Language: Puzzles and content are primarily in English; we do not guarantee availability in other languages.

Your Content: By submitting Content (e.g., feedback, rankings), you:

• Warrant that it is yours or you have rights to use it.
• Grant Us a worldwide, non-exclusive, royalty-free, revocable license to use, edit, and display it for Service-related purposes (e.g., promotion).
• Waive moral rights (e.g., attribution) where applicable.
• May revoke this license by emailing support@mysudoku.com.

Infringement Claims: If you believe your Intellectual Property Rights are violated, email support@mysudoku.com with:

• A description of the rights and infringement.
• Location of the material.
• Your contact details and a signed statement of ownership or authorization.

MySudoku.com uses Third-Party Providers (e.g., Google AdSense for ads, Analytics for usage data). We are not responsible for their availability, content, or policies. Review their terms (e.g., Google’s Terms) before engaging.

• These Terms remain effective until terminated by You (by ceasing use) or Us (e.g., for violating these Terms).
• Upon termination, you must stop using MySudoku.com. Provisions on Privacy, Intellectual Property, Liability, and Dispute Resolution survive termination.

MySudoku.com is provided "as is" with no warranties, express or implied, including for fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee:

• Uninterrupted or error-free access.
• Freedom from viruses or harmful components.
• That Services meet your expectations.

You use MySudoku.com at your own risk.

To the fullest extent permitted by law, We, our affiliates, and Third-Party Providers are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use or inability to use MySudoku.com.
• Unauthorized access or data breaches.
• Errors in Content or Services.

Our total liability, if any, is limited to amounts you paid Us in the 12 months prior to a claim, if applicable.

You agree to indemnify and hold Us harmless from any claims, damages, or costs (including legal fees) arising from your use of MySudoku.com, breach of these Terms, or violation of third-party rights.

These Terms are governed by the laws of Poland, unless you are in the USA (see "Dispute Resolution for U.S. Users" below). If any provision is unenforceable, the remaining Terms remain in effect.

General: Most issues can be resolved by contacting support@mysudoku.com. Unresolved disputes fall under Polish jurisdiction, except for U.S. users.

For U.S. Users:

• Arbitration: Disputes will be resolved via binding individual arbitration under the American Arbitration Association (AAA) Consumer Rules (www.adr.org), not in court, unless you opt out within 30 days by emailing support@mysudoku.com.
• Exceptions: Small claims court or injunctive relief for Intellectual Property violations are permitted.
• Process: Arbitration occurs in your county or an agreed location, with costs governed by AAA Rules.
• Class Action Waiver: Claims must be individual, not class-based. If this waiver is unenforceable, arbitration terms are void.
